These Terms and Conditions ("Terms") govern your use of Thirsty Thursday Picks ("the App"), operated by Dan Delaney ("we," "us," or "our"), accessible at https://www.thirstythursdaypicks.com. By accessing or using the App, you agree to be bound by these Terms.
Thirsty Thursday Picks is a private, invitation-only sports contest application that allows a group of friends to submit predictions on the outcomes of sporting events. The App is intended for personal, non-commercial entertainment use only among invited participants.
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are 18 years of age or older. The App is accessible by invitation only — participants must be manually added by a commissioner.
SMS notifications are optional and are offered only as a convenience for contest-related updates. Consent to receive SMS messages is not a condition of account creation, contest participation, or use of the app. Users receive SMS only after direct consent, which is recorded through the web form or obtained personally by a commissioner who knows the participant. If you provide your mobile phone number — either directly to a commissioner or via the consent form at https://www.thirstythursdaypicks.com/opt-in — you consent to receive SMS text messages from Thirsty Thursday Picks related to your contest participation. Commissioners can share contest links and results with you by other means (e.g. forwarding a link directly) if you prefer not to receive texts. These messages include:
Message and data rates may apply. Message frequency varies based on contest activity, typically 2–4 messages per contest. To opt out, reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE to any message, or contact the commissioner who invited you and request to be removed from the group. To resume SMS notifications after opting out, submit a new consent request at https://www.thirstythursdaypicks.com/opt-in or contact the commissioner who invited you.

All content, design, and functionality of the App is owned by Dan Delaney. You may not copy, reproduce, or distribute any part of the App without prior written permission.
The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, accuracy of sports scores, or timely delivery of SMS messages. Sports data is sourced from third-party providers and may occasionally be delayed or incorrect.
To the fullest extent permitted by law, Dan Delaney shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
We reserve the right to suspend or terminate access to the App for any user at any time, for any reason, without notice.
We may update these Terms from time to time. Continued use of the App following any changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
